What is a Power of Attorney

 

There are 2 types of ‘Power Of Attorney’, Property and affairs, and Health and Welfare.

A Property and Affairs Lasting Power Of Attorney enables the person you appoint make key decisions about your property and finances. This just does not just mean sorting out assets, it also includes important tasks such as paying your bills and expenses.

A Health and Welfare Lasting Power Of Attorney enables the person you appoint make key decisions relating to your care and medical treatment when you are not able to do so yourself.

Unfortunately, we can’t see what the future holds and therefore nobody can guarantee that they will remain physically and mentally capable of making key decisions for themselves in the future. Life can change very quickly and therefore this is something that should be considered as part of your will and from an age when you have any assets, not just when you are elderly.

Data protection legislation is complicated and nobody is usually allowed to deal with your assets and financial matters without your consent making a POA vital to have your wishes carried out.

A lasting power of attorney ensures that things are black and white, that you are assigning a person/persons to deal with your affairs if you are not in a position to do so.
